| Life, Health and Disability Insurance |
| We founded our firm for the specific purpose of giving life, health and disability insurers a high quality and cost-effective alternative to large law firms. To that end, we have assembled a team of talented attorneys with prior experience as agents, claim handlers or in-house counsel to support the efforts of veteran trial attorneys with real experience in litigating life, health and disability insurance claims. The result is a unique blend of claim and litigation risk management that more readily translates into courtroom success. |

| ERISA Litigation |
| In ERISA cases, understanding the current state of the law does not guarantee success. To the contrary, the plaintiffs’ bar is actively trying to change the law, and uninformed judges are too often receptive to those efforts. We therefore use our experience to anticipate cutting-edge arguments, plan for how individual judges will likely respond to them, and take full advantage of successful defense strategies being used across the country. |

| |
| Bad Faith Litigation |
| By its nature, litigation is risky. In insurance-related litigation, those risks are magnified by exposure to tort remedies that plaintiffs cannot recover in other contexts. As skilled trial attorneys, we help insurance companies effectively manage those risks by treating each bad faith case as an opportunity to prove that the insurer’s actions were taken in good faith and – more importantly – led to the correct claim decision. |

| |
| Long Term Care Insurance |
| We are pioneers in the long term care insurance industry, having directly participated in litigation that established the California Insurance Commissioner’s authority to approve of tax-qualified long term care insurance policies and having helped develop a number of related statutory amendments. The role our firm has played in shaping California law with respect to long term care insurance makes us uniquely qualified to assist clients in the investigation and/or litigation of questioned claims for long term care insurance benefits. However, our experience as bad faith litigators also gives us a valuable perspective that can help insurers in this field avoid litigation altogether. |
| |
| Insurance Coverage |
| Our attorneys have prepared detailed and comprehensive opinions regarding numerous types of insurance coverage, including that provided by life, health, disability and long term care policies, commercial general liability policies, automobile and homeowners’ policies, errors and omissions policies, directors’ and officers’ liability policies, excess policies and reinsurance treaties. We also have litigated hundreds of insurance coverage disputes. We therefore understand the sometimes elusive distinction between the duty to defend and the duty to indemnify. More importantly, we appreciate the practical challenges involved with proving when those duties do (and do not) exist. |
